Frequently Asked Questions

Gale Law focuses exclusively on estate litigation and elder law matters. Our team helps clients with Will challenges, Power of Attorney disputes, capacity claims, estate administration issues, and cases involving the financial abuse of seniors.

A Power of Attorney dispute arises when there are concerns about how someone is managing another person’s finances, property, or personal care under a Power of Attorney document. We assist by reviewing the decisions made, ensuring accountability, and protecting the best interests of the individual involved.

You may challenge a Will if you believe it was made under undue influence, if the person did not have the mental capacity to create it, or if the Will was not properly executed according to Ontario law.

The most frequent reasons include:

  • Lack of mental capacity
  • Undue influence or pressure
  • Improper signing or witnessing of the Will
  • Fraud or forgery

A capacity dispute arises when there is doubt about whether a person was mentally capable of making decisions related to their Will, finances, or care. We provide guidance and legal action to clarify and protect the rights of those involved.

We approach elder law disputes with sensitivity and respect. Our focus is on protecting vulnerable seniors, addressing financial exploitation, and resolving conflicts that may arise within families or with caregivers.

Common warning signs include sudden changes to banking activity, unexplained withdrawals, new “friends” managing money, changes to Wills or Powers of Attorney, and unpaid bills despite sufficient funds.

Mediation brings all parties together with a neutral third party to find a fair resolution without going to court. It’s less adversarial, more cost-effective, and often helps preserve family relationships.

In many cases, yes. Mediation can resolve disputes more quickly, privately, and at a lower cost than litigation. However, some disputes may still require a court decision.

Yes. We regularly work with other lawyers who need specialized guidance in estate litigation matters. Our team provides consulting, strategy, and support tailored to each case.
